According to Archival Documents the Problem of Alimony in Ottoman Empire from the Late 19th Century to the Early 20th Century, pp. 541-565

From the early periods of Ottoman Empire, the alimony paid by men and received by women on behalf of themselves or their children was an important source of income for the family's cost of living. Based on Islamic law, Ottoman Empire puts emphasis on providing alimony for the families after divorce as well as during marriage. Thanks to the developments in modernization in the 19th century, women started to seek rights by taking this situation to the courts more effectively. Although the state tried to stand by women as a requirement of the social state understanding, it could not prevent the problems on this issue. Especially, when the men who left their families were found, they were made to pay some alimony in advance, but they did not make their next payments. Women in an endless waiting wanted to terminate this uncertainty and get rid of the heavy burden on their shoulders. There were those who turned back to their hometowns or tried to end their families financial difficulties, as well as those who didn’t want to meet with their families and got divorced. On the other hand, the state gave essential supports to the homeless families and families of the soldiers. The state exempted them from military service when it was necessary. Especially, towards the end of the 19th century, the problems of the non-Muslim families in alimony cases due to the internal and external problems of the state were tried to be solved with the slogan of unity and solidarity whic was “tebaʻyı devlet-i milliyeye hâkim tabiʻi nesebinden”.

Erken dönemlerden itibaren Osmanlı Devleti'nde erkekler tarafından ödenip kadınların kendisinin ya da çocuğu adına aldığı nafakalar ailenin geçimi adına önemli bir gelir kaynağıdır. İslam hukukunu esas alan Osmanlı Devleti, evlilik içerisinde olduğu gibi boşanma sonrasında da ailenin nafakasının sağlanmasına önem vermiştir. 19. yüzyılda yaşanan modern gelişmeler ile birlikte bu durumu mahkemeye daha fazla taşıyan kadınlar, dolayısıyla bir hak arayışına girmişlerdir. Sosyal devlet anlayışının da bir gereği olarak devlet kadınların yanında durmaya çalışsa da bu konudaki sıkıntıları engelleyememiştir. Özellikle ailesini terk edip giden erkekler, bulunduktan sonra peşinen bir miktar nafaka sağlasalar da daha sonraki ödemelerini gerçekleştirmemişlerdir. Sonu gelmeyen bir bekleyiş içerisinde olan kadınlar, hem bu belirsizliği ortadan kaldırmak hem de omuzlarındaki ağır yükten kurtulmak istemişlerdir. Memleketine geri dönen ya da ailesinin geçim sıkıntısını sonlandırmaya çalışanlar olduğu gibi, onlarla görüşmek istemeyip boşananlar da vardır. Kimsesi olmayan aileler ile asker ailelerine ise, devlet gereken desteği sağlamıştır. Gerekirse askerlikten muaf tutmuştur. Özellikle 19. yüzyılın sonlarına doğru devletin içte ve dışta yaşadığı sorunlardan kaynaklanan, gayrimüslim ailelerin nafaka davalarında yaşadığı problemler ise, “tebaʻyı devlet-i milliyeye hâkim tabiʻi nesebinden” şeklinde birlik ve beraberlik sloganı ile çözülmeye çalışılmıştır.
